The FY 2010 JAG Formula Program: Local Solicitation deadline has been extended. The new application deadline is 8:00 p.m. ET on July 7, 2010.

If your jurisdiction is eligible for FY 2010 Local JAG funding, and you have already submitted your grant application and received a successful submission confirmation in GMS, thank you for your timely submission.

As of this time however, BJA estimates that more than 300 eligible local jurisdictions have not yet applied.  In light of the economic conditions within many local communities and other technical factors related to this year’s eligibility, BJA believes that it is necessary to extend the deadline for an additional week, in order to allow jurisdictions additional time to apply.  BJA greatly appreciates the tremendous effort that many of you have put into the process in order to meet the deadline and apply successfully, in many cases well prior to today.  We hope you agree however that it is important for us to give local jurisdictions additional time to apply, so that all eligible communities can continue to benefit from JAG.  This deadline will NOT be further extended.

 

Please note that this email is being sent to all prior JAG recipients and does not necessarily confirm your jurisdiction’s eligibility under FY 2010 Local JAG. Eligible jurisdictions under FY 2010 Local JAG are limited to units of local government appearing on the FY 2010 Local JAG Allocations list. To view this list, visit www.ojp.usdoj.gov/BJA/grant/10jagallocations.html. Please verify your eligibility, and if eligible, review the associated Local JAG solicitation (http://www.ojp.usdoj.gov/BJA/grant/jag.html) and submit an application for funding through the Office of Justice Program’s (OJP) Grants Management System (GMS) at: https://grants.ojp.usdoj.gov/.

 

Applications must be submitted by July 7, 2010, regardless of whether the 30 day governing body review requirement has been satisfied. BJA will hold applications prior to processing until the 30 day governing body review requirement has been met OR attach a withholding of funds special condition to the award until the governing body requirement has been satisfied.

 

Submission is strongly encouraged well before the due date of 8 p.m. (Eastern), Wednesday, July 7, 2010.

Massachusetts Casino Gambling Update

As some of you are aware, the legislature is working very hard to get a piece of legislation passed that will allow casino gambling in the Commonwealth of Mass. Masscop was present at the very beginning of this piece working to ensure that our membership would be represented in the legislation. As you may have heard by now, the piece came out with language that gave exclusive jurisdiction to the State Police on these properties. President Cameron and Vice President Scanzio responded quickly, meeting with the Speaker of the House Robert Deleo, to voice our concerns and dismay that our members were not being fairly represented in the piece. Since that time there has been a number of language changes proposed and the process continues. We are hopeful that this piece will come out with dual jurisdiction language included. This will preserve our right to work in these establishments if they are in our member communities.

Mashpee Quinn Suit Update! Judge Denies Town’s Motion To Dismiss Case To Proceed To Ruling On Merits

Earlier this week Massachusetts Superior Court Judge Robert Rufo denied the Town of Mashpee’s motion to dismiss the Quinn bill lawsuit brought by several Mashpee Officers. The Suit contends that the Town violated the law when it reduced Quinn Bill payments to officers based on an anticipated reduction in state funding. After hearing argument, Judge Rufo denied the motion from the bench, an unusual move. The case will now proceed to a decision on the merit.

The suit alleges that under the Quinn Bill, a municipality may NOT reduce Quinn bill benefits, even if the collective bargaining agreement between the municipality and its union would purport to allow a reduction. This is because the Quinn Bill is NOT a statute that parties may amend via bargaining. Allowing a Town to reduce Quinn benefits is the same as allowing it to pay officers below the minimum wage. Even if the contract says it’s permissible, it is not.

“We’re extremely happy that Judge Rufo refused to dismiss the case. The officers will now have their case heard on its merits,” said Sandulli Grace’s Bryan Decker, who argued for the officers. “We’re confident that we will prevail and that the Town will be ordered to pay its officers the full benefit to which they are entitled.”

Even assuming that the case will be successful, educational benefits for officers are not ensured in the future. The legislature already “closed” the program to newly hired officers; and the Governor is pushing further changes that would ALLOW a town to reduce payments if the state short changes the town on reimbursement. “It’s pretty disgraceful, the state’s reduction in Quinn reimbursement is nothing more than a back door local aid cut,” says Decker. “Nonetheless, towns and cities can’t just cut police officers’ pay. That’s outrageous.”
